Contest Rules
Your
participation in the Mobile Rules! Competition (”Competition”) is
subject to these Terms and Conditions and all applicable laws and
regulations. By entering the Competition, you accept, without
limitation or qualification, these Terms and Conditions, and
acknowledge that any other agreements between you, Nokia or
Competition sponsors (together as “Organizers”) are superseded
with respect to this subject matter. If you do not agree and accept,
without limitation or qualification, these Terms and Conditions,
please do not enter the Competition.
By reviewing these Terms and
Conditions, you agree to the following rules governing the
Competition.
Intellectual Property Rights
Trademarking and filing of any intellectual property rights for the entries is
highly recommended before entering the Competition.
Eligibility
-
The
Competition is open to all individuals, developers and
entrepreneurs. Employees of Organizers, are not eligible to
participate in the Competition. The immediate family (spouse,
parents, siblings, and children) and household members of employees
of Organizers may not participate in the Competition.

Participation
in the Competition constitutes the participant's full and
unconditional agreement to these Terms and Conditions.

Entries
must be the participant's own original work
-
Any
and all application entries must be new to the general public and
not published prior in any media. Mobile applications that are
currently available commercially are not eligible.

Submitted
applications must work on Nokia platforms.
-
Business
plan entries must be new to the Competition. Entries previously
attended Web2Mobile competition are not eligible.

Nokia
has right to dismiss and disqualify any entry at its sole
discretion, at any phase of the Competition.

The
Competition is subject to the laws of Finland. Void where prohibited
by law.
Duration of Program
The
Competition begins at 12:00 GMT on July 12, 2007 and will end at
11:59 GMT on November 23, 2007 for business plans and January 25,
2008 for mobile applications; Organizers reserve the right to
shorten, extend, modify, or cancel the Competition at its sole
discretion, at any time. Organizers will disqualify any entries
received after the due date.
You
can find the schedule, any milestones and prizes of the Competition
from the competition home pages at www.mobilerules.org. The
Organizers shall reserve the option of any time changing the
schedules, milestones and prizes at their sole discretion.
Judging Criteria
The panel will judge all entries including but not limited to the
following criteria:

Uniqueness,
novelty value and innovativeness - display creativity in
applications and business plans, use established technology in
unique ways, offer new solutions, channels, etc.

Design
- leverage latest technologies, quality, file company patents.
-
Market
potential and growth - create breakthrough product, provide new
business opportunities, establish new revenue channels, investor
value.
-
Overall
end user experience - ease of use, ability to fulfill users’
needs, customer adoption.
After
the panel has announced finalists and winners its decision is final
and can not be subject to any litigation.
Mobile Application Prizes
Nokia reserves the right to change the prizes at its sole discretion, at
any time.

The Fine Print

The
Competition administrator will handle any irregularities, and its
decision is final.

Prize winners must comply with paperwork requirements.

The
Organizers reserve the right to not designate an award recipient in
any category where the judges conclude that the level of entries was
not of the necessary quality.

No
transfer or assignment of prize will be allowed. The prizewinner
will be solely responsible for paying all taxes and fees associated
with the winning of the prize.
Privacy and Confidentiality
The
Organizers may use any personal data (for example, your name,
address, telephone number or e-mail address) you transmit by
electronic mail or otherwise in accordance with the Privacy Policy.
In
addition, Organizers will
use personal information submitted to contact winner(s).
Organizers
will treat any other communication or material you transmit, such as
questions, comments, suggestions or the like, as non-confidential and
nonproprietary.

Limitation of Liability

are not responsible for incorrect or inaccurate transcription of
information, for problems related to any of the equipment or
programming associated with the Competition or utilized by the
contestant, for any human error, for any interruption, deletion,
omission, defect, or line failure of any telephone network or
electronic transmission, for problems relating to computer
equipment, software, inability to access the Website or online
service, or for any other technical or non-technical error or
malfunction.

These
Terms and Conditions constitute the entire agreement between
Competition contestants and Organizers pertaining to the subject
matter hereof and supersedes all prior or other arrangements,
understandings, negotiations and discussions, whether oral or
written. No waiver of any of the provisions of these Terms and
Conditions shall be deemed or shall constitute a waiver of any other
provisions hereof (whether or not similar), nor shall waiver
constitute a continuing waiver unless otherwise expressly provided.
Release
By
entering the Competition, each contestant fully and unconditionally
releases and holds harmless Organizers, and their parents,
affiliates, subsidiaries, directors, officers, employees and its
advertising, and promotional agencies from any and all liability for
any injuries, loss or damage of any kind arising from or in
connection with the Competition or receipt, redemption, use or misuse
of any prize won, except to the extent that this release may be
limited by applicable law.
Trademarks
Any
trademarks appearing in this Competition including but not limited
to, Nokia and of the other organizers are the property of their
respective owners. Any use of such trademarks is strictly prohibited
without prior written explicit agreement with the owner.
General
-
This
competition shall not constitute a commitment or create a joint
venture, partnership, agency or other media or business relationship
between the participants and the organizers of this competition.
This competition shall not either be understood to grant to any
participant whether expressly or by implication any ownership,
rights or license to any intellectual property rights of any of the
organizers and vice versa.

Nokia
reserves the right to disqualify any contestant who tampers with the
operation of the Competition or Web site or violates the Terms and
Conditions of the Competition. CAUTION: ANY ATTEMPT BY ANY
INDIVIDUAL, WHETHER OR NOT A CONTESTANT, TO DELIBERATELY DAMAGE OR
UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION OR THIS WEB
SITE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN
ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY
SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

You
are prohibited from posting or transmitting any infringing,
threatening, false, misleading, abusive, harassing, libelous,
defamatory, vulgar, obscene, scandalous, inflammatory, pornographic,
or profane material or any material that could constitute or
encourage conduct that would be considered a criminal offense, give
rise to civil liability, or otherwise violate any law; Nokia will
fully cooperate with any law enforcement authorities or any court
order requesting or directing Nokia to disclose the identity of
anyone posting or transmitting any such information or materials;
and you are prohibited from advertising or perform any commercial
solicitation.
